| I understand that this trip is subject to the terms and conditions of the tour participant agreement (TPA) which I hereby acknowledge receiving and to which I agree to be bound. I further understand that STS, as tour operator, and it's employees and agent-SAT, act solely as agents in arranging transportation and accommodations offered in connection with this travel package. In consideration for the promises contained in the tour participation agreement, I agree to indemnify and hold STS/SAT, it successors and assigns, harmless from and against any and all claims, demand, causes of action, damages, costs, liabilities, fees, penalties and expenses, including attorneys fees and costs, arising out of or resulting from any actions, including any misfeasance, malfeasance, negligence or intentional act or omission of mine, with respect to the trip described in this agreement. STS/SAT and successors, assigns, officers, directors and agents, shall not be liable for any act, omission, injury to person property, loss, inconvenience, accident delay, irregularity, negligence or default of any company, hotel, carrier company and/or their employees, servants or subcontractors providing any services, accommodations, or facilities in connection with this agreement except for its own gross negligence, willful misconduct or bad faith. STS/SAT will not be responsible for any actions including, but not limited to, (1) over booking by hotels, (2) missed connections to or from charter fights, (3) failure to follow instructions, including but not limited to check-in/check-out times, baggage handling and reconfirming bus/flight times. |

Student Adventure Travel Inc. ("SAT") acts as nationwide booking agent. Tour Operator - Student Travel Services, Inc., 1413 Madison Park Dr., Glen Burnie, MD 21061 has arranged the vacations advertised for this spring break program. Student Travel Services, Inc. ("STS") acts as tour operator. PLEASE NOTE THAT IF YOU ARE UNDER THE AGE OF 18 AT THE TIME OF SIGNING THE APPLICATION, YOUR PARENT(S)/GUARDIAN(S) MUST ALSO SIGN. STS/SAT will not be responsible for forged signatures. If you register and/or travel without a required parent(s)/guardian(s) signature on this Application. (Over 18) Each participant must print and sign his/her own name. Your participation on this program and trip will constitute an implied consent on the part of you and/or your parent(s)/guardian(s). Do not sign TPA for someone else under penalty of the law. Occasionally another / substitute Tour Operator maybe used from US departure points. Safety and security in our brochure are references only to companies and knowledge of activities that we offer. Caution by traveling passenger and his/her group should be exercised for traveling either on domestic or international trips in general.Package Price: See pricing on brochures and fliers for specific features included in package price. Hotels/categories, departure cities, and departure dates are listed on brochures & flyers (check with reservations for updated pricing) plus are incorporated in this agreement by reference. New reservations postmarked after December 15, 2006 must add $30 to published "early-bird" prices. New reservations postmarked after February 5, 2007 must add $60 to published "early-bird" prices. Package prices are based on current rates and are subject to change at any time prior to departure without notice due to fuel-related increases, changes in government taxes, etc. Departure Taxes and Fees: All U.S. and foreign departure taxes and fees are due with final payment. In the event that any portion cannot be prepaid, tour participant must pay that amount upon check-in and a refund will be issued following the tour. This fee is $120 as of May 1, 2006 update. Registration fees for bookings postmarked by December 15th, 2006 are $15 per person, plus any applicable fuel surcharge. HOW TO MAKE Reservations/Payments: Tour participant: make $100 per person deposit ($50 for hotel only packages) payable to Student Adventure Travel. STS has escrow account with National City Bank/STS Charter Escrow. Room Coordinator: Call Student Adventure Travel (SAT) at 1-800-328-7513 to check price, availability, make reservation by telephone, and receive a confirmation number. Deposit and signatures of each student traveling on reservation form are required for each student in our office within 5 business days to secure reservation. Room Coordinator, please gather the signed reservation form and payments and mail in one envelope. Do not forge your roommate's signature! Monthly "No Interest" payments are offered. Please check the appropriate box on your reservation form for the payment plan that meets your and your roommates needs. All roommates must be on same payment plan. Upon receipt of deposit, SAT will send confirmation/invoice to room coordinator. Receipt of deposit by SAT constitutes acceptance of these terms and conditions. There is a $40 service charge for all checks returned to SAT due to insufficient funds or stop payment. Final Trip Documents: Final trip documents will be mailed to SAT 5-7 days prior to departure. These documents will then be proofed and forwarded by registered mail/delivery service to room coordinator per confirmation number (usually between 2-4 days before departure). Documents will not be released until everyone in your party is paid in full. Some documents for the 2007 spring break can be downloaded from our web sites. Please read all correspondence from SAT. All room leaders need to share correspondence with roommates. Credit Card/Wire Transfer Payments: All prices listed on SAT brochures or quoted via phone reflect a discount for payment via checks or money orders. All other forms of payment, such as credit cards and wire transfers must add $25 per person to all prices. Credit card payments must be accompanied by Credit Card Form which can be downloaded from www.beachbreaks.com . VISA, MasterCard, Discover & AMEX are accepted between September 1, 2006 and February 15, 2007 on all payments except initial payment. Initial payment must be personal check, cashier’s check or money order only. Cancellations & Late Fees: All Payments Received by SAT are non-refundable except as provided in this paragraph. Cancellation policy is 60 or more days prior to departure - $150 per person charge for international destinations and U.S. air inclusive packages - $75 per person charge for land only packages; 59-45 days - 50% of total trip cost charge will be charged; 44 days or less - 100% of total trip cost will be charged. Substitutions or replacements will facilitate a full refund less $50 per person administrative name change fee and any airline/charter-imposed fees (generally $75 per person) will be passed on to the customer. This latter fee of $75 is always charged for name changes within 44 days of your departure weekend in addition to the $50 name change fee for a total of $125. If a roommate(s) cancels, you and your remaining roommate(s) must pay applicable occupancy surcharges prior to the departure date. Change requests will be attempted, however each airline/hotel tour operator has different rules, regulations, penalties and deadlines. No guarantees or pricing estimates are implied. SAT will attempt in its best efforts to effect customer requests. Late Fees (payment due dates mean received in our offices by specified date-not postmarked by specified date): Late charges of $25 per person are automatically charged at 7 days overdue on payment dates. Avoid penalties by submitting payments by due dates or earlier! Late payments of more than 10 days overdue are subject to $25 per person fee mentioned above and may be subject to space available status. Due to the tremendous amount of bookings, credit cards may take a longer time to process than with other businesses that you may be used to. Make sure your credit card charge(s) will be accepted at time of processing. Declined credit cards are subject to late fees. Changes include all changes such as: name changes, unit changes, property changes, etc. **Late bookings after Dec. 15, 2006 a fee of $30 and after February 5, 2007 a fee of $60 on "Early Bird" pricing per person charged automatically to "Early Bird" published prices. Attention: there is a $40 service charge for all checks returned to SAT due to insufficient funds or stop payment. Any discounts, coupons, rebates or agreed to deductions at time of booking will be void and reversed on a per person basis, if participant is late in their agreed to payments by 10 days, 2 or more times. Travel Protection Plan: Optional Travel Protection for Cancellation, Delay, Health, Accident, and Baggage is Strongly Recommended. Travel protection will automatically be added to all trip invoices. A copy of the relevant travel protection policy is available from STS upon written request to SAT. You may decline the policy by indicating or circling the "no" on your signed registration form during initial reservation. A circled "yes" or absence of a response will automatically include this insurance. Insurance is per person and is non-refundable after initial trip deposit is posted in our offices. Insurance may not be purchased within 60 days of trip date unless submitted with initial registration form for late bookings. This is a highly recommended option. Changing Your Reservations: There is a $50 per person fee (plus any airline/charter-imposed fees -typically $75 per person) for changing your reservation in any way once deposit has been received by SAT. 44 days or less, both fees are charged for a total of $125 per change. Adding passengers to an existing reservation will not be considered a change. See cancellation paragraph above for specific details. Name changes are free of charge until Sept 15, 2006. Baggage: Air Carrier liability for loss, damage, or delay to luggage is limited to the actual proven value of such luggage, but not more than $9.07 per pound for checked luggage and $400 unchecked baggage on international flights, unless you declare a higher value and make additional payment prior to departure. All passengers are permitted two pieces of luggage not to exceed 44lbs in combined weight. Carry-on luggage is limited to one bag per person and must be small enough to fit under the seat in front of you. Neither the Airline or STS will accept responsibility for jewelry, cameras, and money stored in checked baggage. Be certain to use your STS luggage tags. STS luggage tags aid our airport representatives in identifying our travelers and help the hotel transfer process to run smoothly. Any lost or damaged luggage must be immediately reported to an airline representative. Please do not leave the terminal until you have completed a claim form. Please consult airline ticket for limits on luggage liability. Security Agreement: All payments received by STS for charter travel services such as this are protected in part by a Surety Trust Agreement by and between National city Bank-Michigan/Illinois, N.A. ("Bank") and STS in favor of the U.S. Government. Claims should be filed directly with STS and Bank or if STS is unavailable, with Bank, Attn. Trust Financial Services Division, Travel Industry Services Manager, 1001 South Worth, Birmingham, MI 48009-6943, within 60 days after completion of the trip. In the event Bank and/or STS fail to receive your claim within this time period, Bank and STS shall be released from any and all liability to you. Documentation: Travelers to and from Mexico and the Caribbean (including Jamaica and the Bahamas) will be required to have a passport to enter or re-enter the United States. This is a change from prior travel requirements. This new requirement will also affect certain foreign nationals who currently are not required to present a passport to travel to the United States. Students under 18 years of age must carry a certified letter of consent signed by both parents or legal guardian for travel outside the U.S. This permission form can be downloaded from www.beachbreaks.com U.S. citizenship documentation requirements are subject to change without notice. No refunds will be issued for passengers who are denied boarding for failure to obtain proper citizenship documentation. Security Deposit: Hotels may require up to a $100 per person security deposit at check-in, most properties in all destinations are $50 per person. Be prepared both ways. This will be refunded upon checkout provided that there are no charges or damages to your room. Some properties may allow credit card usage for this, however, most properties require cash or travelers checks. Unused Tour Services: No refund will be issued for unused accommodations, flights, or tour services if the tour participant leaves the tour for any reason or misses tour. Aircraft, Flight Schedules and Delays: Public charter air services are provided by Miami Air Int'l, Omni Air Express, Falcon Airlines, World Airways, Allegro Airlines, Northwest Airlines, North American, Sun Country, Tower Air, TransMeridian, Planet Air, Tradewinds Airlines, Champion, Pan American or American Trans air. Public charters are operated by STS, WCV, American Trans Air Vacation's, Apple Vacations, GWV, TNT, Funjet, Vacation Express, VTI, and HMHF. Scheduled air services are provided by Air Jamaica, Continental, US Airways, American Airlines, Northwest, TWA, Delta, and Southwest. STS and the airline reserve the right to substitute any duly-licensed air carrier and/or to change aircraft type, routing and do not guarantee single plane or nonstop service. Flight Delays: Flight delays are unfortunate, but are inherent risk in air travel. Flight delays, missed nights accommodations and expenses incurred due to flight delays, and missed connection to/from charter flights are beyond the control and responsibility of SAT/STS. In the event of a charter delay, in addition to DOT regulate compensation, STS subscribes to the following passenger compensation* guidelines - Outbound/return total delay of less than 12 hours: No compensation; Outbound/return total delay between 12 and 24 hours: $30 per person credit on future trips; Outbound/return total delay of greater than 24 hours: $50 per person credit on future trips. *This charter compensation schedule is nontransferable, valid for one year, and does not apply to weather-related air traffic control, or security related delays or to passengers who do not travel. SAT shall not be responsible for delays, cancellations, or other problems arising from strikes, weather, or other causes beyond its control. It is the policy of SAT to make its best efforts in resolving problems. Flight Schedules/changes: Flight times are not guaranteed and may affect actual length of time in vacation destination on travel days. Any flight information provided prior to departure is considered tentative and is subject to change in accordance with Operator's Option Plan as set forth at the bottom of this agreement. Therefore, it is the sole responsibility of the tour participant to reconfirm both outbound and return flights. Departures are assigned Friday, Saturday or Sunday of your weekend. Flights can be anytime around the clock. Operator Cancellation: If STS must cancel the charter. STS will notify you within 7 days of the cancellation, but in no event later than 10 days before the scheduled departure date. In the event of complete cancellation, STS's only liability will be refund, within 14 days of the date of cancellation, all moneys paid. STS, as charter operator may not cancel the charter less than 10 days before the scheduled departure date, except for circumstances that make it impossible to perform the charter trip, including, but not limited to, any acts of God, the declaration of war or engagement in major hostilities by the United State or the occurrence of any other local, national or international emergency calamity relating to the effective operation of the governments involved, and that if landing rights are denied by a foreign government, the flight will be canceled with a full refund to the participant within 14 days of the date of cancellation. Customer Service: If you require assistance in any way while on your tour, you must notify our on-location staff (telephone numbers and office locations furnished in your vacation guides) who will make every effort to accommodate you. Under no circumstances will STS/SAT reimburse you for long-distance phone calls or other out of pocket expenses. If the matter cannot be resolved, please write our Customer Service Department within 60 days of the completion of your tour. Failure to write to STS within this 60-day time period will release STS/SAT from all claims and liability. Major Change: In accordance with Part380 of the DOT's Special Regulations, the applicable major changes are as follows: (1) a change in departure or return dates of more than 48 hours (unless the changes result from a flight delay experienced by the carrier), (2) a change in origin or destination city for any flight leg or other than a change in the order in which cities are visited, (3) a substitution of any hotel that is not named in the operator-participant contract: and (4) a price increase of more than 10% occurring more than 10 days prior to departure. If STS becomes aware of a major change 10 or more days prior to departure, STS will notify participants within 7 days of first knowing of such change. If STS should become aware of a change within 10 days of departure, it will notify tour participants as soon as possible. Upon receiving notification of a major change, tour participant may cancel in writing within 7 days but in no event later than the date of departure, the participant may decline to accept the change and be sent a refund for the portion of his or her payment allocated to the hotel accommodations or transportation provided within 14 days after scheduled return date. In either case, STS/SAT shall have no further liability to the tour participant. Hotels are booked as categories and are interchangeable within. Operator's Option Plan: All trip dates have been sent to coincide with your Spring Break. STS will use Friday, Saturday, or Sunday departures at all hours around the clock. The following are considered "co-terminal" airports: (Newark, LaGuardia and JFK), (BWI, Reagan National and Dulles,) and (O'Hare and Midway). Your airport and final trip dates will be assigned no later than 10 days prior to the departure date, in-frequently these dates & times may not be available until SAT receives documentation in time frame as stated above. Land changes: STS reserves the right to substitute equivalent accommodations when necessary or departure cities with ground transportation provided or remunerated in emergencies. Wristbands/Activity packages due to nature of these subcontracted activities details and inclusions may change without notice. Miscellaneous: All notices, offers, acceptances, requests and other communications hereunder shall be in writing and shall be deemed to have been duly given if mailed by certified or registered mail, with postage prepaid, to STS/SAT when delivered or within three (3) business days after it is mailed. The validly and construction of this agreement or any of its provisions shall be determined under the laws of the State of Maryland. Any controversy or claim arises in accordance with the rules of the American Arbitration Association. The site of such arbitration shall be the principal office of STS located in the State of Maryland or such other locations as STS, in its sole and absolute discretion, may specify. The decision of the arbitrator shall be final. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The invalidity or enforceability of any provision of this agreement shall not affect or limit the validity and enforceability of the other provisions hereof. This agreement contains the entire understanding between the parties hereto and supersedes any other oral and written agreements or understanding between them. Except as otherwise provided for in this agreement, no modifications or addition hereto or waiver or cancellation of any provision shall be valid except by a writing signed by the parties. This agreement shall bind an inure to the benefit of the parties, and their respective successors and assigns or personal representatives. STS may assign this agreement without the tour participants’ permission. The tour participant may not assign any part of the benefits of this agreement to another party without STS's express written permission. High school students are urged to attend graduation trips in May and June. Spring Break is designed for college age students.
